eThekwini Municipality says Mojo's Investment CC will take over the municipal restaurant property at 17 Erskine Terrace, South Beach, under a lease lasting nine years and 11 months. The City's 13 October news item follows a competitive process launched in November 2023.
The municipal tender-award register identifies the procurement as contract 7E-23408: a lease of the 584m² restaurant building on Erf 12281 Durban, with no renewal right. It records an award date of 17 July 2024, an award value of R15,187,200 and says the City will receive R22,322,417 in rental over the lease term. The new municipal release does not repeat or reconcile those two figures, so Civic Ledger records them separately as published in the award register.
The municipality says an unsuccessful bidder lodged an appeal under section 49 of its Supply Chain Management Policy. The independent Appeal Authority dismissed the appeal, after which judicial-review proceedings were instituted and later withdrawn. The City says the withdrawal notice was filed in the KwaZulu-Natal Division of the High Court in Pietermaritzburg on 1 October 2026; Civic Ledger has not independently inspected the court file.
The award can now move into implementation, but the City has not yet disclosed the new venue's opening date, concept, capital-investment amount or expected employment. The next accountability records are the signed lease, rental schedule, handover and commencement dates, and any development obligations attached to the property.
What it means
The end of the legal challenge removes the immediate obstacle to implementing a municipal-property award that was recorded in 2024. Delivery can now be measured against the signed lease, rental receipts and the operator's development obligations rather than the announcement alone.
