National Treasury has published a draft Local Government: Municipal Finance Management Amendment Bill for public comment. Government Notice 8078 appeared in Government Gazette 55612 on 21 October 2026, with written submissions due by 29 January 2027.

The one-page gazette notice directs comments on the municipal bill to MFMAComments@treasury.gov.za and says the draft bill and its memorandum are available from Treasury. It also warns that commentators’ names and submissions may be made public and may be disclosed under access-to-information law.

Treasury’s February 2026 Budget Review set out the policy direction before the bill was released. It said the amendments would enforce funded municipal budgets, strengthen expenditure controls and consequence management, and clarify irregular-expenditure treatment so that attention is focused on financial losses.

The same Budget Review said the bill would strengthen monitoring and intervention tools for national and provincial treasuries, including financial-recovery measures and safeguards during interventions. Those descriptions are Treasury’s stated objectives; the consultation process may still change the text before any bill is submitted to Cabinet and introduced in Parliament.

The publication is a legislative consultation, not a procurement notice or contract award. It carries no tender reference or municipal allocation. For municipalities, the consequential issue is that the proposed rules could reshape how unfunded budgets, irregular expenditure and financial distress are handled if Parliament later enacts them.

What it means

The draft is the clearest legislative step yet in Treasury’s promised overhaul of municipal financial governance, but its operative effect depends on revision, Cabinet approval, parliamentary passage and commencement.
